Falun Gong once initiated its propaganda to recklessly hype the lawsuit concerning accuser Zhang Qingxi, president of Taiwan Falun Dafa Association, and the defendants including Hu Litai, president of United Daily (Taiwan), and Luo Guojun, chief editor of the newspaper office.
An article titled "Taiwan Falun Dafa Association accuses United Daily of fabricating document and libeling gravely" was published on the website of Minghui.org on June 9, 2010, claiming that "Zhang Qingxi submitted an indictment to the Taipei District Prosecutors Office and accused Hu Litai and Luo Guojun of fabricating document and libeling gravely as joint tortfeasors".
At that moment, the article also attached a photo of Zhang Qingxi, who seemed swaggering at the gate of Taipei District Prosecutors Office. (See picture one)
Here was what happened. Yang Weixiang, a follower of Falun Gong in Taiwan, read an article titled "Keeping Going on Immaterial Cause of Great Morality" on April 26, 2010. He thought that the article "runs counter to the doctrine of immaterial cause of great morality stated by his Master Li Hongzhi and disregard the life and safety of Falun Gong followers". In addition, "since the Falun Gong organization was involved in political affairs, many followers declared their quit from the organization".
Based on these facts, Yang Weixiang published an announcement "Attention: All Falun Gong Followers in Taiwan Concerning the Immaterial Cause of Great Morality" on the advertisement section at page A10 in the newspaper of United Daily on May 11, 2010.
Accordingly, Zhang Qingxi submitted an indictment with the announcement to the Taipei District Prosecutors Office, accusing Hu Litai and Luo Guojun, respectively the president and chief editor of United Daily, of the so-called guilt of "fabricating document" and requesting for tracing the culpability of grave libel for the defendant and all joint tortfeasors.
On Sep. 16, 2010, Taipei District Court delivered the criminal verdict, rejecting the indictment of Zhang Qingxi. But Zhang refused to accept and appealed to the Taiwan High Court on Oct. 15, 2010. As a result, the Taiwan High Court made the final verdict on Nov. 1, 2010 that Zhang Qingxi's appeal was invalid and he was permanently deprived the right of appeal. The written judgment was sent to the parties on March 23, 2011.
The verdicts of Taipei District Court are as follows:
First, the applicants (Zhang Qingxi) appealed that the 5 defendants, Yang Weixiang, Wang Xiaolan, Wang Bicheng, Wang Wenshan and Zhou Zuoxian, were involved in fabricating document and interfering with reputation, and requested to submit the defendants to trial. The appeal doesn't conform to the Law and shall be rejected. (Page 4④)
Second, the applicants requested to submit Hu Litai and Luo Guojun to trial for their crime of fabricating document. The criminal verdict is that the applicants' second appeal is rejected for unlawfulness not groundlessness, and is signed on Nov. 1, 2010. The appeal was rejected for not in line with the first item in term 258 in Criminal Procedural Law. Here shows its content that the applicant shall not submit to trail based on this section of Law. Thereby, the request of the applicant here is illegal and shall be rejected. (See page 4)
Third, the applicant requested to submit Hu Litai and Luo Guojun to trial for their offenses against personal reputation. The criminal verdict is that the evidence provided by the applicant through investigation suffices to show the publishing act of United Daily but does not suffice to show any libel of the defendants Hu Litai and Luo Guojun, the original verdict is appropriate. The appeal shall be rejected for groundlessness. (See page 4, 8, 9)
Ironically, a sharp contrast was that the Falun Gong-related media completely turned mute after Zhang Qingxi was defeated in the lawsuit, compared with their vaunted hype at the very beginning.
